This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our web application, AI tutoring and proctoring services, and interactive workspaces (collectively, the "Services"). Because Ninchi is a real-time, multimodal AI platform that requires access to your camera, microphone, and screen, we believe in radical transparency regarding how your data is handled. By accessing or using our Services, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy.
1. Information We Collect
To provide our 1:1 digital human experience, we collect information across four main categories: A. Account and Profile Information Personal Details: When you create an account, we collect your name, email address, password, and account preferences. Authentication Data: We may collect data associated with third-party single sign-on (SSO) providers, such as Google or Microsoft, if you choose to log in using those services. B. Multimodal and Proctoring Data (Sensory Inputs) Audio Data: Real-time voice inputs captured via your microphone to allow you to converse with the AI tutor. Video and Camera Data: Real-time video feeds to allow the AI to see your physical environment, monitor your engagement, and provide interactive feedback. Screen and Interaction Data: Real-time analysis of your screen activity, keystrokes, mouse clicks, and digital drawing or writing to provide contextual tutoring and enforce proctoring rules. Behavioral and Integrity Signals: During proctored assessments, the AI analyzes eye movement, background noise, and physical presence to flag potential academic integrity violations. C. User Content ("Notebooks") Uploaded Materials: We collect the text, PDFs, presentations, and raw learning materials you upload to create Notebooks. Generated Outputs: The transcripts of your conversations with the AI, assessment scores, and AI-generated study guides. D. Automatically Collected Usage Data Device Information: IP address, browser type, operating system, and hardware specifications. Log Data: Session durations, error logs, and performance metrics essential for optimizing our low-latency infrastructure during our Beta phase.
2. How We Use Your Information
We use the information we collect for the following purposes: To Provide the Services: Processing your audio, video, and screen inputs in real time to generate the digital human's responses and behavioral feedback. To Enforce Academic Integrity: Analyzing multimodal data during proctored sessions to ensure fairness and compliance with assessment rules. To Facilitate Sharing: Hosting and distributing the Notebooks you choose to share with other users within the Ninchi ecosystem. To Improve the Platform (Beta Phase): Analyzing usage logs and error reports to fix bugs, reduce latency, and improve the accuracy of our computer vision and LLM integrations. Communication: Sending you administrative emails, account updates, and notices regarding changes to our Beta features. AI Model Training: We process your real-time multimodal data, including camera and microphone inputs, strictly to provide the live tutoring or proctoring session. We do not use your personal video, audio, or uploaded User Content to train our foundational AI models without your explicit opt-in consent.
3. How We Share Your Information
We do not sell your personal data. We only share your information in the following circumstances: With Cloud and Infrastructure Providers: We utilize secure third-party cloud hosting and compute providers to process the computational loads required by our AI. These providers are bound by strict confidentiality agreements. With Other Users (User-Directed): If you create a Notebook and share the link, the recipients will have access to the learning materials and assessment parameters you established. With Educational Institutions or Employers: If you are using Ninchi as part of an organization-mandated assessment, your proctoring results, behavioral flags, and session transcripts may be shared directly with that organization. For Legal Compliance: We may disclose your information if required to do so by law, or in response to a valid subpoena, court order, or government request.
4. Data Storage and Security
Transient Processing: Much of the video and audio data processed by Ninchi is transient, meaning it is processed in real time by the AI and is not permanently stored after the session ends unless a recording is explicitly required and disclosed for proctoring audits. Security Measures: We implement industry-standard encryption, including TLS and SSL, for data in transit and at rest. However, no internet transmission is 100 percent secure, and you use the Services at your own risk.
5. Children's Privacy (COPPA and FERPA)
Because Ninchi is an educational platform, protecting the privacy of minors is a top priority. Under 13: We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent. If we learn we have collected such information without consent, we will delete it immediately. FERPA Compliance: For schools and universities operating in the United States, Ninchi Industries acts as a School Official with a legitimate educational interest. We process student data solely to provide the contracted educational services.
6. Your Data Rights and Choices
Depending on your location, you may have the right to: Access: Request a copy of the personal data we hold about you. Delete: Request the deletion of your account, uploaded materials, and saved session transcripts. Opt-Out of Camera and Microphone Access: You may revoke camera and microphone permissions via your browser or device settings at any time. We may update this Privacy Policy from time to time, particularly as we transition from Beta to full release and add new features.
